Domain names conflict with trademarks in many cases, however, trademark owners often try to use their trademarks to intimidate people into relinquishing domain names that really do not conflict.

LegoToys.com: This one is a no-brainer. Of course the owners of lego got this got this one.

onurair.com: Another lay-down. The domain was an exact match to the trademark.

, , , , and : These are all exact matches to the trademarks owned by the complainant.

If you register a domain name that exactly matches someone’s trademark, you will lose the case every single time, so my question is; “Why do you do it?”.

Others and I have been fighting very hard to eliminate the grace period for domain name registrations. The AGP or Add Grace period allowed you to register a domain name and get your money back if you wanted it back within 5 days.

This led to domain name tasting used by specuolators to grab hundreds and even thousands of domain names at once, try them out with made for adsense pages to see if they would make a profit, then drop the ones that did not without any cost to them.

The problem really got bad when those dropped names were then picked up by another domain taster and so on and so on. This tied up hundreds of thousands of domain names that were not available to anyone but the domain tasters.

ICANN took their sweet time, but finally did something to at least slow domain tasting down.

ICANN is today posting an AGP (Add Grace Period) Deletes Status Report [PDF, 73K] to publicize how use of the AGP has dramatically changed following implementation of the AGP Budget Provision and the AGP Limits Policy. The Provision was approved by the ICANN Board and the Policy the outcome of the GNSO Policy Development Process on Domain Tasting. The report provides statistical information on AGP deletes activity by TLD for the period June 2008 through April 2009.

As I said, new TLDs are coming regardless of whether ICANN wants them to or not. Here is another new TLD announcement;

New TLDs are coming. Some of them are TLDs that ICANN does not want you to see. Soon there will be an easily downloaded program that will enable your DNS to allow you to see ALL of the Internet, not just the portions ICANN and the US Gov want you to see.

Large corporations lobby to keep ICANN from introducing more TLDs into the main root where you can see them. This is why you have to register a long 4-word or more dot com domain name rather than one that makes sense for your online marketing efforts.

Hundreds, if not thousands of TLDs exist right now. They work just fine. The default settings for your Internet connection from your ISP do not allow you to see them. This is by design to create a false shortage of domain names.

Ok, now you know that other TLDs exist and work just fine. Why can’t you go to a website located on one of these TLDs?

Because, the US dept. of Comerce put ICANN, a nonprofit org, in charge of the “main root”. ICANN makes sure your Internet Service Providers only provide access to that “main root”. They are basically filtering what you can or cannot see without your knowledge.

Subscribe to this blog if you want to enable your computer to see all of the Internet rather than than the filtered version you are getting now. If you thought the Internet had huge potential before, you’re gonna love this. I will soon have a program you can download that will enable your computer’s DNS so you can see websites that exist on other roots your ISP is blocking.

I own Dot SEO. Other TLDs include Dot Lawyer, Dot CPA, Dot Artist, Dot Church, Dot Graphics, and 100’s more. The Internet reads like a phone book when your DNS is enabled.

ICANN and the big corporations do not want you to access these TLDs. It will mean that Dot com is not king anymore and that people will have more choices. This reduces the monopoly that certain companies currentlt enjoy.

Imagine going to cpa.search to find a CPA. Imagine going to Lawyer.search or Attorney.search to find a lawyer? Would Google and other search engines like TV commercials promoting this alternative means of searching the web? Nah.

Imagine being able to own your company name in the right TLD rather than com, net, org, biz, info, etc. Such as JamesSmith.cpa, SuemBreakemandScrewem.attorney, ChrisMcElroy.SEO, etc. Now would you really prefer a dot com over being able to choose the right TLD for your company? Nah. Would Network Solutions like Dot Com not being the preferred choice for domain names? Nah.

So now you see a few reasons why you are being filtered so that you do not see the real possibilities the Internet has to offer.
